Registration of Account

• You may access and use the Platform as a registered User or guest User. However, not all sections of the website will be accessible to all guest users.
• You can create a registered user account by providing Eicher Sure certain User information as requested by Us, following which You can create a specific log-in ID (“Login”)
• If You use the Platform, you are responsible for maintaining the confidentiality of Your account and for restricting access to Your computer to prevent unauthorized access to Your account. You agree to accept responsibility for all activities that occur under Your account.
• Please ensure that the details you provide Us are correct and complete and inform Us immediately of any changes to the information you provided when registering. You can access and update much of the information you provided Us in the Your Account area of the Platform. Eicher Sure reserves the right to refuse access to the Platform, terminate accounts, or remove or edit content at any time without notice to You.
• You may be required to provide certain personal information, and We may collect certain personal information. Your provision of, and VECV’s collection, storage, use, disclosure, and otherwise dealing of such personal information shall be governed by VECV’s privacy policy, which is available at https://www.eichertrucksandbuses.com/privacy-policy (“Privacy Policy”).
• The Platform and the intellectual property attached to the Platform belong exclusively to VECV or its Licensors. Any trademarks used on the Platform but belonging to a third party shall remain the property of that third party.

Communications

• You hereby agree to receive communications via SMS, Email, Phone, or any other means from Eicher Sure relating to the Platform Services provided through the Platform.
• You can unsubscribe/opt-out from receiving communications from Eicher Sure through SMS and e-mail anytime at eichersure@vecv.in.

These Terms and Conditions may change without notice, and it is your responsibility to check the Terms and Conditions each time you access the Website.

The User is confirming that he/she has fully read this Agreement of the Platform and agrees to abide by the same. This Agreement shall adhere to these Terms and Conditions as soon as the User accesses the Platform or any portion of the Platform. Every login, making a bid, or using any of the Services on the Platform shall be considered a re-affirmation to the terms of this Agreement.

Terms and Conditions During Bidding

I/We (Herein referred to as “Bidder” which expression shall, unless repugnant to the context or meaning thereof, be deemed to include its subsidiaries, successors in business and interest, associate, nominees, Legal heirs, and assigns) do hereby agree to buy vehicles from VE Commercial Vehicles Ltd.; having its corporate office at #96, Institutional Area, Sector-32, Gurugram – 122001 and plant situated at Plot No 102, Industrial Area No-1, Pithampur, District Dhar M.P. 454775 (Herein referred to as “Seller”)

This forms part of the Bidding Document for any Vehicles as per the following points:

• The Bidder agrees that the Seller will issue the bill/invoice for any vehicles in the name of the Bidder or buyer as nominated by the bidder, subject to invoicing carried out within one week of winning the auction. Subsequently, no request for alteration/modification in the name of the buyer, as mentioned in the bill/invoice, will be accepted/entertained by the Seller at any point in time.
• Bidder agrees that the sale of any vehicles is on “AS IS WHERE IS BASIS AND CONDITIONS” without AMC. I/We also understand and agree that there is no guarantee or warranty, expressed or implied, with respect to the vehicle.
• The Bidder agrees that the Seller shall have no responsibility regarding the registration of all vehicles, and the buyer will be responsible for the same.
• Bidder agrees, understands, and accepts the terms and conditions contained in the Bidding Documents. The Bidder also agrees that the Earnest Money Deposit (EMD) given to the Seller will be forfeited if the terms and conditions expressly mentioned in these documents are not duly performed by the Bidder. The bidder further agrees that EMD will be forfeited by the seller in case of non-payment of the above-mentioned consideration or vehicle collection on time by the buyer.
• The Bidder is assumed to have inspected the vehicles before sending the quote. If the Bidder buys the vehicle without inspecting it, the responsibility will be entirely of the Bidder.
• Bidder hereby agreed to defend, indemnify and hold Seller harmless from any and all losses, damages, liabilities, costs and expenses (including but not limited to legal fees), incurred by VECV arising directly or indirectly due to breach of any of the terms of this “Terms and Conditions” by Bidder or buyer.
• These Terms and Conditions shall be interpreted and construed exclusively in accordance with the laws of India; Bidder agrees to submit to the exclusive jurisdiction of competent courts in New Delhi, India
